Right, so are other files less than 10MB which fail and give 503 error.

8MB one uploaded without any error.

Thanks. I did upload 6 small pictures and they were uploaded without any error. The size was around between 140kb to 250kb.

I tried the wiki fix already since I have csf running, did not help. lsphp is already in the pignore list as well. The htaccess edit did not help either.

I did post on xenforo forum and their response was that it could be timeout issue.

Hi, 5 and less pictures work without any error. The size does not matter as long as its less than what is defined and all pictures are less than 5000x5000 resolution. I have not tried apache, I will give it a shot and report back.
