sorry for slow reply been working late, I detected this via TOP cmd, Usually its usr/bin/pho but was showing litespeed. Ill remove those folders now. Yes it was still in the init.d, I removed this now :) I cannot test yet untill I reboot, But I should imagen this will resolve the issue yes ?

You should enable: within litespeed to see who the actual user is - Also in the litespeed control panel - What priority is litespeed set to. But even though it may show that CPU its only per view, If its constantly high then its a user issue, Probably cause by a bad script.

Out of memory can only be caused by that - ! I had clients on me saying it when they tried to install an IPB board, I was on 96 and IPB requires 128 ! So I had to switch which fixed things. But it could be several problems ! what is your output of "top"

Sounds like WHM has memory set to low :D WHM > Service configuration > PHP Configuration Editor > memory_limit > Make this HIGHER. Then restart litespeed :) Then try what ever you was doing before it thrown out an error.
